I picked up a FPN back in April for doing 36 in a 30 mph limit. Deeply cheesed off so decided to fight back after the MCN Pace Witness articles about not being cautioned with an FPN etc. Letters have been exchanged but I've now received a summons. Have pleaded not guilty for now, stalling for time but does anyone know what I do now?

Checkout : http://www.pepipoo.com Think the answer's to wait for the police to provide any evidence they wish to use in court within 7 days of the hearing. If they don't, it can't be used. (I think)

Yeah, already loggedinto pepipoo but not had much clarity. I haven't asked for any evidence - should I now?

"Believe" the answer is no. It's likely they've got the evidence, but by asking for proof you'll condem yourself. If they don't volunteer it, they can't use it, so the hope is they wont. Tony Woodhouse seems to have as much insight as any on such things. p.s. unless you really are innocent, of course

I'll give it a go... If they get me, they get me. Justice for getting away with 112 mph last year due to police error. How relived was I!! Course I'm innocent...!!

go here first. VERY important, read through the different postings before doing anything Have a good read of the fightback forums, you can glean a lot. If you're really worried ge a membership. I personally wouldn't ask as they know they have to provide the evidence so you can form a defence. They may come to court without it and when you ask for the evidence they may not be able to produce it. Even if they do you jsut ask as to why you haven't been provided with the evidence as required by law. They cannot then use tha evidence. That is how I understand it; certainley is th case in the case I am involved in but that is a criminal case.

I'm up for the fight! Stinkin beggars nabbed me on Commercial Road where everyday its full of jaywalkers, red light jumps and 'kin mobile phone users. I probably had to do 36 to swerve round the unlicensed cab driven by an illegal while on his mobile! I want my day in Court!!!

Was it a mobile unit? If so was there a sign 200 metres from the unit? If not ask them why not as it is required, if they say there was ask them for proof. Remeber in the end its up to THEM to provide the proof not you.

No, it was a fixed camera. To be honest, I don't recall being flashed at all - it was a complete surprise. I ride that road everyday and know where the camera's are. Just never been caught at that close a limit and its difficult to manage a couple of mph when you're coping with the nutters on the road

Hmm, they could have an interesting time on their hands then, trying to prove it was you cos it must have been a rearward facing camera.
